1.) If I am beating to windward on starboard tack, and another boat is running downwind toward me, and he is on starboard tack (boom to port), then I am the right of way boat, correct?
2.) If I am beating to windward on port tack, and another boat is running downwind toward me on starboard tack (boom to port), then HE is the right of way boat, correct?
When answering these questions, think about boats far away from each other initially, as when you are the 5th fleet starting, and the first fleet has already rounded the upwind mark (on an upwind/downwind course) and is headed back toward you. I.E. I am trying to ask this question without complicating it with overlap and overtaking.

Yes, and even if the boats are in a diferent class, they must follow the same rules even if they feel they are not racing against you. I had some really old farts in Cleveland last year barge in on me at the leward mark and vocally said my protest doesn't count because they weren't in our fleet. I think that same guy had the heart attack at the protest table later that night.
I can take a stab at it. Essentially you can't ram a guy up the transom just because he is going too slow. And if you are passing him from clear behind, you are limited in your actions.
